PARTIES
This Membership Agreement (“Agreement”) has been concluded electronically between Akbaşlar Kumaş [AKBAŞLAR TEKSTİL ENERJİ SANAYİ VE TİCARET ANONİM ŞİRKETİ] (“Akbaşlar Kumaş” or “Service Provider”) on one side and the person who becomes a member of the website www.akbaslarkumas.com (“Member”) on the other side.
SUBJECT AND SCOPE OF THE AGREEMENT
The subject of this Agreement is to determine the rights and obligations of the parties regarding the Member’s membership to the website owned by Akbaşlar Kumaş, benefiting from the services offered through the website, creating an account, and using the website.
This Agreement does not replace the Distance Sales Agreement regulating sales transactions; it only covers provisions regarding membership and account usage.
MEMBERSHIP CONDITIONS
3.1. Membership is completed by filling out the membership form on the website and accepting this Agreement electronically.
3.2. To become a member, one must be over the age of 18.
3.3. The Member accepts that all information provided during membership is accurate, up-to-date, and belongs to them. Any legal and criminal liability arising from misleading or false information belongs to the Member.
RIGHTS AND OBLIGATIONS OF THE MEMBER
4.1. The Member is obliged to keep the confidentiality of their username and password.
4.2. All transactions made through the Member account shall be deemed to have been made by the Member unless proven otherwise.
4.3. The Member accepts that they will use the website and membership account in accordance with the applicable legislation, general morality, and the rules of honesty.
4.4. If the Member shares content on the website, such as comments, reviews, etc., they are responsible for ensuring that their posts are not unlawful and do not violate the rights of third parties.
RIGHTS AND OBLIGATIONS OF AKBAŞLAR KUMAŞ
5.1. Akbaşlar Kumaş undertakes to provide the services offered through the website within the framework of technical possibilities.
5.2. Akbaşlar Kumaş takes the necessary technical and administrative measures to ensure system security.
5.3. Akbaşlar Kumaş may make temporary interruptions in services due to maintenance, updates, or technical necessities. This situation is notified to the Member in advance or resolved as soon as possible.
5.4. Akbaşlar Kumaş reserves the right to temporarily suspend or permanently terminate the membership if the Member acts contrary to this Agreement or the legislation.
INTELLECTUAL PROPERTY RIGHTS
All content on the website, including design, logo, text, visuals, software, and other elements, belongs to Akbaşlar Kumaş or is used under license.
The Member may not copy, reproduce, distribute, or use such content for commercial purposes without the written permission of Akbaşlar Kumaş.
PRIVACY AND PROTECTION OF PERSONAL DATA
The personal data of the Member is processed in accordance with the Personal Data Protection Law No. 6698 within the scope of the Clarification Text and Privacy Policy.
TERMINATION OF THE AGREEMENT
8.1. The Member may terminate the agreement at any time by closing their membership account.
8.2. Akbaşlar Kumaş may suspend or terminate the membership if the Member acts contrary to the provisions of the Agreement or the legislation.
8.3. Termination of membership does not eliminate the rights and obligations arising from previously placed orders.
RESOLUTION OF DISPUTES
In disputes that may arise from this Agreement, if the Member is a consumer, Consumer Arbitration Committees and Consumer Courts shall be authorized.
EFFECTIVE DATE
The Member electronically declares that they have read, understood, and accepted all provisions of this Membership Agreement while becoming a member of the website.
This Agreement enters into force at the moment of this approval.
